California's Community Property System

California is a community property state, meaning that all assets and debts acquired during the marriage are presumed to be equally owned by both spouses. However, the characterization and division of property is rarely straightforward — particularly when separate property has been commingled with community assets, businesses have been built during the marriage, or one spouse has significantly higher earning capacity.

The Divorce Process in California

California requires at least one spouse to have been a resident of the state for six months and of the county where the petition is filed for three months before filing. After the petition is filed and served, there is a mandatory six-month waiting period before the divorce can be finalized. This waiting period is separate from the residency requirement and begins when the respondent is served.

During this time, we work to resolve all issues — property division, support, custody, and any other matters — either through negotiation, mediation, or litigation as needed.
