Temporary vs. Permanent Support

California distinguishes between temporary spousal support (pendente lite) and long-term support. Temporary support is calculated using a county-specific guideline formula and is designed to maintain the status quo during the divorce proceedings. Long-term support is determined by the court after considering the factors set forth in Family Code §4320, including the marital standard of living, duration of the marriage, each party's earning capacity, and the supporting spouse's ability to pay.

Duration of Support

For marriages of fewer than ten years, Family Code section 4320(l) provides that the goal is for the supported party to become self-supporting within a reasonable period of time, generally one-half the length of the marriage, although this is a guideline and the court retains discretion. For marriages of ten years or longer — considered "long-duration" marriages under Family Code §4336 — the court retains jurisdiction over spousal support indefinitely, and there is no presumed termination date.
